"Optimising your SPC strategy" was the topic for Potter Clarkson's latest specialist SPC workshop. Members of Potter Clarkson's SPC and Regulatory group took the opportunity to explore critical issues with an already-knowledgeable audience, with some lively discussion. James Whyte of 8 New Square also explored the meaning of "protected by the basic patent" with the group.
Topics debated included recent case law developments, led by Dr Tony Proctor with his "setting the scene" presentation. Dr John Miles explored biologics and particularly strategies and considerations when defining the "product", critical to SPC validity and enforcement. Also critical to SPC validity and term is "what counts as a Marketing Authorisation", particularly in the context of recent developments aimed at streamlining the regulatory process. This was considered by Drs Michael Pears and Stephanie Pilkington. Finally, Dr David Carling reviewed what is happening post-Neurim and the practical consequences. Further lively discussion followed, continuing through refreshments to round off an interesting and enjoyable day, for which the Potter Clarkson team thanks their guests.
