Unified Patent Court a step closer as the UK takes final legislative step

The final legislative step required for the UK to be in a position to ratify to the UPC Agreement has been confirmed, as secondary legislation in the form of the draft Unified Patent Court (Immunities and Privileges) Order 2017 was laid before Parliament on 26 June 2017.

Resolutions of each House of Parliament, as well as equivalent legislation in Scotland, is required for the order to be passed, but it is expected the UK will be in a position to ratify in the Autumn of 2017. 

“The order implements the protocol on privileges and immunities and gives the UPC its legal personality in UK law,” said a spokesperson for the UK Intellectual Property Office.
